Overview

Josh is the managing partner of Pierce Jewett. A seasoned attorney with a practice focused on issues that arise out of the workplace, individuals and businesses rely on Josh’s judgment to navigate them at critical junctures in legal matters, whether through governmental investigations, compliance issues, deals, or litigation.

Josh has served as lead or co-counsel on over 50 cases in federal and state courts, including in class, multi-party, and individual actions. He has successfully represented businesses facing enforcement proceedings brought by various federal governmental agencies, such as the DOL, EEOC, and NLRB. He has negotiated numerous deals for C-Suite clients. And some of the region’s leading businesses have counted on Josh to navigate their legal matters behind the scenes, ranging from compliance issues to international deals and disputes.

For his work, Josh has been named repeatedly by Virginia Business Magazine as one of Virginia’s Legal Elite for employment law. He has been interviewed by a number of publications to comment on news stories, such as by CNN Money. And his cases occasionally reach publications that only lawyers read, like Law 360.

Josh received his J.D. from Regent University School of Law, where he was a member of the National Moot Court Team. In 2008, Josh’s team was awarded Best Brief and the Regional Champion at the American Bar Association National Appellate Advocacy Competition in Washington D.C.

Josh hails from a poor coal mining town. That upbringing, however, has been invaluable to Josh’s law practice, as it not only forged values within him of determination and grit, but it has also helped him relate to people from all walks of life—both the indigent and the affluent.

Josh has four sons, ages 5 to 14. He and his wife are deeply committed to philanthropy aimed at alleviating poverty, both in the local community and abroad. They are active members of a vibrant, multi-site church in Virginia Beach, where Josh serves as an elder.

Recent Experience

    • Negotiated numerous deals, at both entry and exit points, for C-Suite clients in both privately held and publicly traded companies.

    • Represented numerous individuals under investigation, with a particular emphasis in the government sector space.

    • Lead counsel for hospital system in EEOC enforcement action, resulting in government dismissing investigation.

    • Lead counsel for business clients in NLRB, DOL, and EEOC enforcement action investigations.

    • Obtained reversal for detective in the Fourth Circuit Court of Appeals in ADA case involving issue of first impression. 

    • Lead counsel in 7-day trial against the Department of Labor in FLSA enforcement action regarding the classification of over 1,000 workers. 

    • Obtained trial verdict against the government in Equal Pay Act case on behalf of engineer. 

    • Obtained Summary Judgment on behalf of defense contracting business in case where Plaintiff alleged that she was fired three days after disclosing a medical condition. 

    • Obtained Summary Judgment for Plaintiff in retaliation case against the federal government. 

    • Lead counsel in trade secrets case with claimed damages of $20 million, resulting in favorable settlement for clients.

    • Obtained Order Denying Summary Judgment in whistleblower retaliation case against the government, resulting in successful settlement before trial

    • Lead counsel for chief of cardiology in age discrimination case against a large hospital system, resulting in the firm’s client receiving maximum recovery and reinstatement.
