Overview

Aaron is a well-rounded employment attorney and an experienced litigator.  His practice consists of both traditional employment litigation (e.g., discrimination, harassment, disability accommodation, labor rights, and wage and hour claims) and litigation concerning related areas of law, including contract disputes, business conspiracies, tortious interference with contracts and business expectancies, intellectual property and trade secret protections, and restrictive covenants, including litigation concerning covenants not to compete, non-solicitation restrictions, and non-disclosure agreements.

Aaron also maintains an active counseling practice, which covers a full range of labor and employment issues, including wage and hour compliance, accommodation obligations, drafting and revising employment contracts and executive employment agreements, and executive compensation.

Over the years, Aaron has also developed a niche in the area of investigations, obtaining a series of favorable resolutions in investigations initiated by both state and federal agencies.  Aaron has consistently been named by Virginia Business Magazine as one of Virginia’s Legal Elite for employment law.

Recent Experience

    • Obtained reversal of summary judgment in the Fourth Circuit Court of Appeals on behalf of detective in a case arising under the Americans with Disabilities Act. 

    • Obtained trial verdict against federal government in Rehabilitation Act case on behalf of employee of the Department of the Navy.

    • Lead counsel in collective action arising under the Fair Labor Standards Act on behalf of a group of service-industry workers, resulting in favorable resolution of their overtime and tip withholding claims. 

    • Lead counsel in franchise dispute against nationwide company in which client franchisee was alleged to have owed substantial amounts to franchisor under disputed terms of the franchise agreement, resulting in resolution that included recovery of damages on behalf of client and no money paid to franchisor.  

    • Lead counsel representing management in investigation conducted by U.S. Department of Labor, Wage and Hour division, where the Department alleged successor liability based on management’s prior purchase of predecessor company’s assets, resulting in finding of no successor liability, civil penalties, or liquidated damages. 

    • Lead counsel representing physician employed by U.S. Department of Veterans Affairs in investigation into alleged misconduct, resulting in dismissal of all charges. 

    • Lead counsel representing management in investigation conducted by U.S. Department of Labor, Wage and Hour division, of federal government contractor accused of Service Contract Act violations, resulting in finding that included no civil penalties, no liquidated damages, and no restrictions on future contracting or bidding rights.

    • Lead counsel representing management in investigation conducted by U.S. Department of Labor, Wage and Hour division, of non-profit accused of overtime and recordkeeping violations, resulting in assessment of no civil penalties or liquidated damages.
